Ex-boyfriend faces new charges in killing of West Sayville teen Emily Finn

New charges are coming for accused killer Austin Lynch, 18, of Nesconset, judge says.

The Nesconset teen accused of gunning down his ex-girlfriend as she tried to leave his home in November after their breakup faces new charges, a judge told him Monday during a brief court appearance.

Acting Suffolk Supreme Court Justice Anthony Senft informed 18-year-old Austin Lynch that he would be arraigned on the new charges this Friday, when his defense attorney will be available, Newsday reported.

The specifics of the charges remain under seal, court officials said in the outlet’s report.

“I am going to put this matter back on the calendar for [Friday], which is going to be about the new charges that have been brought against you,” Senft told Lynch in court.

Monday’s appearance came roughly six weeks after Lynch was found not competent to stand trial following evaluations by a pair of mental health professionals, Newsday’s Grant Parpan reported.

In late January, Newsday reported, Senft ordered Lynch committed to a New York State Office of Mental Health hospital until he is able to understand the charges against him and participate in his own defense.

Lynch has pleaded not guilty to second-degree murder in the Nov. 26 shooting death of Emily Finn, 18, of West Sayville who had gone to his home to return his belongings following their breakup. They had dated for three years.

Finn, a 2025 Sayville High School graduate, was a freshman at SUNY Oneonta. She was home for Thanksgiving break.

Prosecutors said Lynch shot Finn once at close range in the back of the head as she was heading out the door, then turned the gun on himself, surviving a shot to his face.
