The clock has ran out on Carmine Agnello’s patience test with the federal court system.
U.S. District Court Judge Nusrat Choudhury handed John Gotti’s grandson a blunt ultimatum Thursday: donate a kidney to his mother by Monday, or report to federal prison that same day to begin serving 15 months behind bars for a $1.1 million COVID-19 fraud scheme.
Choudhury’s order, which modifies her July 17 ruling, gives the 39-year-old exactly one path to a longer reprieve.
If the transplant procedure happens on or before Monday, the Long Island resident gets pushed back to a Sept. 18 self-surrender date. If it doesn’t happen by then, there’s no more wiggle room — he’s due at the Bureau of Prisons by 2 p.m. on Monday.
The latest deadline leaves Agnello of East Norwich no room for another delay. Agnello pleaded guilty in 2024 and was originally looking a prison sentence of more than 33 months before Choudhury began granting him extensions so he could donate a kidney to his mother, Victoria Gotti, 63.
Gotti has chronic kidney disease and has said her son is her only compatible match. The Gambino crime family boss’s daughter and “Growing Up Gotti” star has repeatedly begged the court to spare her son prison time, calling him her “Miracle Child.”
Whether that gift happens by next Monday now determines whether Agnello walks into an operating room or a federal prison first.
