The Lake Ronkonkoma man accused of driving on the wrong side of the road and plowing into a Nesconset road crew last month, killing one worker and seriously injuring two others, faces a 19-count grand jury indictment, including aggravated vehicular homicide.
Thomas Lobianco, 26, is due to be arraigned on the indictment Wednesday morning in Suffolk County Court in Riverhead, according to court records. Suffolk County District Attorney Raymond Tierney is expected to make a public statement on the case afterward.
The charges
Lobianco’s aggravated vehicular homicide charge stems from the death of construction worker Joel Sicon-Porix, 38, of Mastic.
The indictment also includes second-degree manslaughter, aggravated vehicular assault, second-degree vehicular manslaughter, first-degree vehicular assault, and two counts of second-degree vehicular assault. Each charge is a felony tied to Sicon-Porix’s death and the serious injuries suffered by his two coworkers.
Also on the indictment: two counts of driving while ability impaired by drugs, along seventh-degree criminal possession of a controlled substance, second-degree reckless endangerment and reckless driving.
Notably, the indictment includes a count of fourth-degree criminal possession of a weapon, a charge that had not surfaced in the case previously.
The Aug. 10 incident
Police said Lobianco had just finished an overnight shift at a nearby 7-Eleven and sat in his car for about 20 minutes before pulling out around 6:40 a.m. on Aug. 10.
Driving a 1999 Toyota Camry east in the westbound lane of Townline Road, he allegedly ran a red light at the Terry Road intersection, drove onto the sidewalk and struck three workers with Laborers Local 1298 who were preparing a paving job for East Moriches-based Rosemar.
Lobianco’s car then hit an electronic crossing sign and a utility pole before obliterating a vinyl fence.
Sicon-Porix, a father of three, was pronounced dead at Stony Brook University Hospital. His coworkers, Kevin Chavez-Sarmiento, 30, of Bay Shore and Jose Gonzalez-Colindres, 33, of Brentwood were hospitalized with serious injuries.
Lobianco was arrested that day and initially charged with driving while ability impaired by drugs. He pleaded not guilty at his initial arraignment in Suffolk First District Court in Central Islip; a prosecutor told the judge at the time there was a high likelihood of upgraded homicide charges.
A GoFundMe organized for Sicon-Porix’s wife, Glendys Zacarías, and their three children has drawn widespread community support toward funeral expenses and the family’s care. Nearly 500 donations totaling $50,000 have poured into the fundraiser.
A separate GoFundMe for Chavez-Sarmiento and his recovery has raised $3,700. Additionally, a GoFundMe for Gonzalez-Colindres, a father of two young gurls, has collected $3,200.
