MRI nightmare: No jail time for tech who ordered girl, 16, to strip, pose for unneeded images

A Wheatley Heights man convicted of endangering the welfare of a child after instructing a teenage patient to pose in unnecessary and sexually suggestive positions during a routine MRI exam was sentenced to a conditional discharge, avoiding jail time despite prosecutors’ push for incarceration, the district attorney’s office announced Friday.

Robbie Baguio, 37, worked as an MRI technician at the Bohemia branch of Orlin & Cohen Orthopedic Group when the October 2023 exam took place, Suffolk District Attorney Raymond Tierney said. The victim, then 16, had gone in for a routine scan of her hamstring after a soccer injury.

Baguio told the girl to remove her shorts and underwear without offering a covering, prosecutors said. After the teen questioned the instruction, Baguio repeated the directive and a gown was eventually provided.

With the gown tied only at the neck, her back was left exposed unless she held it closed herself.

Baguio took images with the teen lying on her back, then told her the images weren’t sufficient and directed her into a series of additional positions that exposed her, prosecutors said. Trial testimony established that those later poses were not medically necessary for the exam and that no diagnostic images were even taken during that portion of the test, Tierney said.

Later, the girl told her mother about the exam, and the family contacted police.

Baguio was arrested months later, on June 6, 2024. He waived his right to a jury trial and proceeded to a bench trial before Suffolk County District Court Judge Eric Sachs, which began Aug. 5, 2025. Sachs returned a guilty verdict June 11, 2026, on the sole count of endangering the welfare of a child, a misdemeanor.

At Baguio’s sentencing on Thursday, prosecutors said they asked for the maximum split sentence, which is 60 days in jail plus three years of probation, along with sex offender conditions and an order of protection. Suffolk County’s Probation Department had recommended straight probation with alcohol and narcotics conditions instead.

Sachs ultimately imposed a conditional discharge, a mandatory surcharge, and a stay-away order of protection for the victim.

“This defendant was convicted of endangering the welfare of a child for using his authority as a healthcare technician to prey on a young girl who was simply in need of a routine exam,” Tierney said Friday.

He commended the victim for testifying against Baguio at trial and asked anyone with a similar experience involving Baguio to contact Suffolk Police Department or the DA’s office.
